This last year, the American Tax Credits Group has been a strong partner of the EDC Business Expansion and Retention (BEAR) Action Network. Recognized as the top private-public partnership in the State by the California Association for Local Economic Development (CALED), the EDC BEAR Action Network is comprised of dozens of partners offering over 27 business expansion services, collectively. The common theme amongst the partnership is the shared commitment to supporting the existing businesses of the region, regardless of size, type, or industry. Our strategic objective is to grow the economy of Fresno County, one business at a time.

Consequently, I am pleased to report that the American Tax Credits Group (ATG) is one of these valued team members. When marketing the many tax credit programs available in this area, our initial approach is to train company representatives (HR managers, Controllers, etc.) to do the tax credit screening themselves. But on many occasions, our business clients request to be connected to 3rd party professionals that can do the screening for them. Whether the assistance is needed due to staff limitations or time restraints, some company leaders are simply not able to incorporate the tax credit screening processes into their operation. It is at this time that we call on our partners at ATG. Their entire team is very professional, knowledgeable, and highly effective at maximizing the greatest returns for our business clients. California #1 in Tax Increases

The National Conference of State Legislatures has released a new report showing that of the States that imposed tax increases last year, California’s were the most, and that last year’s tax increases were the largest in California’s history. From the Sacramento Bee:

California wasn’t alone when it boosted state taxes last year to cope with its budget deficit; nearly half of the 50 states also increased taxes, according to a new survey by the National Conference of State Legislatures.

However, California’s increase in income, sales and auto taxes was the largest in state history, pegged at the time at $12-plus billion and accounted for nearly half of the $28.6 billion in new taxes levied by 24 states.

Voters reacted sharply to the increase, which was adopted in early 2009 after weeks of political infighting, and rejected a series of ballot measures that would, among other things, have extended the taxes. Without the extension, the added levies will begin phasing out at the end of this year, worsening the chronic gap between income and outgo.

West Sacramento Receives Final Designation

West Sacramento, Calif., March 2, 2010 – The City of West Sacramento today announced that it has received final designation as an Enterprise Zone by the California Department of Housing and Community Development.

The West Sacramento Enterprise Zone extends throughout the majority of the City and includes portions of the Clarksburg area. The zone has been granted designation until January 2023.

“This is an important step in our continuing efforts to strengthen and diversify our City’s economy,” said Christopher Cabaldon, West Sacramento Mayor. “The tax benefits and other financial incentives that this program provides are an important tool for encouraging the type of business and job growth we want to see here.”

The California Enterprise Zone program provides special state and local incentives to encourage business investment and promote job creation in economically distressed communities. There are currently 42 Enterprise Zones in California.

Businesses located within a California Enterprise Zone are eligible for substantial State tax and financial benefits, including a hiring tax credit, sales and use tax credit, increased expense deductions, and preference for state contracts.

The City expects a substantial number of businesses to take advantage of the Enterprise Zone benefits. Businesses can receive more information about the benefits of locating in West Sacramento online at www.cityofwestsacramento.org.

California communities receive these designations from the State of California through a competitive process. While Zones have similar goals for improving the economic vitality of their communities, each is unique in the local incentives and special assistance they provide to the businesses located within the zone boundaries.

FTB “Tax News” January 2010

In the June 2009 issue of Tax News the question was asked, “Are you familiar with California’s Enterprise Zones?”

We now ask, “Are you aware some taxpayers who work in an Enterprise Zone may be entitled to a credit for the wages they earned?”

The Enterprise Zone tax incentive programs were created to help local businesses, and encourage outside businesses to locate in economically depressed areas. Also, the programs have a provision that allows low income individuals working within an Enterprise Zone to claim a credit that may help eliminate their California tax liability.

The Enterprise Zone Employee Credit is claimed on form FTB 3553 and the taxpayer must file a Form 540 or the Long Form 540NR to claim this credit. The Enterprise Zone Employee Credit can only be used to offset the tax attributable to employment within the enterprise zone. If a taxpayer earned wages in more than one zone, a separate form FTB 3553 is needed for each zone.

The following business-related tax incentives are also potentially available to a taxpayer doing business in an Enterprise Zone, so you may want to see if your clients are doing business within one of the state’s many Enterprise Zones.

Hiring credit.
Sales or use tax credit.
Business expense deduction.
Net interest deduction for lenders.

Enterprise Zone tax incentives apply only to business activities and investments that take place in an Enterprise Zone that has received final designation.

While these Enterprise Zone incentives have been around for quite some time, there have been recent changes to the zones.

For a listing of all Enterprise Zones, expired, active and conditional, or to check if any of your clients work or have a business located within an Enterprise Zone, go to the California Department of Housing and Community Development (HCD) website at www.hcd.ca.gov/fa/cdbg/ez/.

Clovis added to the Enterprise Zone

The City of Clovis has received a designation to join Fresno County’s Regional Enterprise Zone, making more than 500 industrial and commercial businesses eligible to receive exclusive state tax incentives.

Some of the businesses now part of the zone include Pelco, Anlin Windows, Valley Chrome, Hodges Electric and Krazan Engineering. Some of the industrial parks benefiting include the Gettyburg Industrial Park, Central Clovis, Johnson and the Dry Creek Research and Technology Park.

The Enterprise Zone is a partnership between local government and private companies to generate new private sector investment and growth. Under this program, companies are eligible for incentives and programs including tax credits for sales tax paid on qualified machinery, tax credits for hiring new employees and accelerated expense deductions

Clovis is the 14th city in Fresno County to join the program.

In these times of economic slowdown, Dan and Jennifer Gonzalez say their decision to move their business into an enterprise zone has paid off.

The co-owners of Custom Wood Products in Parlier took advantage of the state program to accelerate depreciation on their new building, putting the money they saved on taxes back into their business.
